Both are fatally flawed, but may still work anyway. SCO may not have a case, but if they can create the expectation of a problem they can succeed at inflating their stock price, extorting money from Linux users, and/or discouraging new Linux deployments. Similarly, the CAN-SPAM act has all kinds of problems (opt-out vs. opt-in, and jurisdiction outside the US), but if it can raise the expected cost of sending spam it may be effective. This article from the BBC notes that Spamhaus estimates 90% of spam comes from about 200 spammers.
